"Carrot Top National Prop Contest"
1. NO PURCHASE OR PLAY NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE OR PLAY WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.
2. The Competition: In conjunction with Luxor Las Vegas, Carrot Top is in search of the perfect prop to use in his live show at Luxor Las Vegas. The winning prop maker will receive round-trip airfare for two, two-night hotel accommodations at Luxor Las Vegas, dinner for two at Luxor Las Vegas and two tickets to see Carrot Top live at The Luxor Las Vegas. NO PUNS!!!
3. Eligibility; Verification:
(a) Eligibility: The Competition is open to any individual at least 21 years of age or older and is a legal resident of one of the 50 United States or the District of Columbia. Employees and their immediate families (i.e., parents, spouses, children, siblings, grandparents, step parents, step children and step siblings) of Sponsors and each of their affiliated companies, sponsors, parent companies, subsidiaries, advertising agencies, third party fulfillment agencies and their respective agents, employees, officers, directors successors and assigns (collectively, the “Competition Entities”), are not eligible to enter the Competition. Individuals who are excluded from casino facilities, including through a government program, at Luxor’s discretion, or by their own request, are not eligible. By participating in the Competition, Competitors (a) agree to be bound by these Official Rules and by the interpretations of these Official Rules by Sponsors, and by the decisions of Sponsors, which are final in all matters relating to the Competition, (b) agree to release and hold harmless the Competition Entities, from and against any and all claims, injury or damage arising out of or relating to participation in this Competition and/or use or misuse or redemption of any prize and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action; and (c) acknowledge compliance with these Official Rules. Competitors must also not be, during the time period of this Competition or at time of prize fulfillment and acceptance, a party to any agreement with any record label, production company, publishing company or any third party that might interfere with Competitors’ participation in the Competition, the rights granted by Competitor in connection with this Competition (including, but not limited to, rights granted in connection with Programming as set forth in Section 8 below) and/or acceptance of the Prize (as hereinafter defined) awarded. Competitors may submit multiple entries.
(b) Verification: Competitors must prove eligibility, including, but not limited to, proof of age and legal residence. In the event of non-compliance by a Competitor, he or she shall be disqualified and all privileges otherwise due to such Competitor be terminated. Eligible Competitors must agree to (i) a declaration of eligibility and release of Competition Entities, and their respective parent companies, affiliates, and subsidiaries and each of their respective officers, directors, employees, agents, members, from any and all liability, loss, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Competition or the use/misuse or acceptance of any prize and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related cause of action; (ii) a promotional release granting Competition Entities the right to use Competitor’s name and likeness for advertising and publicity purposes without additional compensation. Entry into this Competition constitutes Competitor’s agreement to agree to these Releases. By submitting a prop and agreeing to that site’s terms and conditions, Competitor is also agreeing to adhere to “Releases” mentioned above. Competitors must also acknowledge that Competition Entities have not and will not obtain or provide insurance of any kind relating to the participation by Competitors in the Competition or Prize-related travel and activities and that the Competitors will be responsible for obtaining and paying for any life, travel, accident, property or other form of insurance relating to the Competition or any prize prior to competing in the Competition or Prize-related travel and other activities.
4. How to Enter/Entry Period: Competitors must submit a completed prop for potential submission into the Carrot Top show at Luxor Las Vegas. The website’s landing page will have complete instructions as how where and how the props are to be submitted. The Competitor prop should be, though doesn’t necessarily have to be, similar to what is viewed nightly on the stage at the Carrot Top show at Luxor Las Vegas. The prop must be submitted to the contest between the start of the Competition (no earlier than November 24, 2009) and the end of the Competition period (no later than 11:59pm Pacific Time on May 1st, 2010).
(a) Competition: Starting on November 31, 2009, all submitted props that qualify for the Competition will be reviewed by a group that represents the Sponsors. Until the end of the Competition, each submitted prop will be reviewed by this group until midnight Pacific Time on May 1st, 2010. The winner of the competition will be announced during the week of May 1st, 2010.
Luxor Las Vegas will cover the cost of the airfare for winner and a guest to Las Vegas. Flight must be roundtrip and originate from one of the continental 50 United States or District of Colombia. The flight must be to Las Vegas McCarran International airport and will be booked by a representative of the Sponsors. Roundtrip transportation to and from Las Vegas McCarran International airport will also be provided for the Finalists.
Luxor Las Vegas will provide (1) standard hotel room for (2) nights for the winner; plus dinner at one of the Luxor’s fine dining establishments.
In order to qualify as a Finalist, the Competitors must be available to fly to Las Vegas, Nevada. The specific dates will not be known until closer to the Competition and will not necessarily be made known to the general public. The Winner will adhere to the terms and conditions applied to transportation, lodging, and meals.
(b) Competition Selection of Winner: The decision on the winning prop is at the sole discretion of the group representing the sponsors.
6. Prizing: The winning prop creator will be awarded round-trip airfare, two nights accommodations at Luxor Las Vegas, dinner at one of Luxor’s fine dining establishments and two tickets to the Carrot Top show at Luxor Las Vegas.
Date and location of the Competition is subject to change by Sponsors in Sponsors’ sole discretion. In the event the Competition is cancelled for any reason, Sponsors’ hold no obligation to alert the Competitors, nor do they need to fulfill the prize as outlined above.
7. General Prizing Terms: No substitution, transfer, assignment or cash equivalent of the Prize or any portion thereof, will be permitted. All costs and expenses not specifically listed above, including, without limitation, meals, snacks, beverages, entertainment, tips, and souvenirs, personal expenses, any travel and/or equipment to be used in connection with the Prize are solely Winners’ responsibility. Sponsors’ shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations necessitated by same. Sponsors’ shall not be liable for any loss or damage to the Competitor, baggage or any other personal item.
The value of the Prize may be taxable to the Winners as taxable income. Winner must supply Sponsors’ with their social security numbers and other information required for tax purposes. An IRS Form 1099 may be issued in the name of the Winner for the actual value of the Prize received. Winners are solely responsible for reporting and payment of any federal, state or local income taxes, if any, on the Prize. Sponsors shall have no responsibility or obligation to the Winner who is unable or unavailable to accept or utilize the Prize as described herein.
9. General Terms: Noncompliance with any of these Official Rules may result in disqualification. ANY VIOLATION OF THESE OFFICIAL RULES BY A COMPETITOR OR ANY BEHAVIOR BY A COMPETITOR, OR A COMPETITOR’S PARENT OR LEGAL GUARDIAN THAT WILL BRING A COMPETITOR OR COMPETITION ENTITIES INTO DISREPUTE (IN COMPETITION ENTITIES’ SOLE DISCRETION) WILL RESULT IN SUCH COMPETITOR AND THE APPLICABLE COMPETITOR’S DISQUALIFICATION AND ALL PRIVILEGES TO COMPETE OR WIN WILL BE IMMEDIATELY TERMINATED.
Competition Entities assumes no responsibility for incorrect or inaccurate registration information whether caused by any of the equipment or programming associated with or utilized in this Competition or by any human, mechanical or electronic error which may occur in the processing of the registrations in this Competition. Competition Entities are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any transmission on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including, without limitation, any injury or damage to Competitor's or any other person's computer related to or resulting from participation or downloading any materials in this Competition. Competition Entities are not responsible for any typographical or other error in the printing of the offer, administration of the Competition, errors in processing registrations, identifying potential or actual Competitors or in the announcement of any Competitors, Winners and/or the delivery of the Prizes or any component thereof. If, for any reason, the Competition is not capable of running as planned, in whole or in part, including, without limitation, changes planning, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures of equipment used at the Competition or any other technical failures, or any other causes beyond the control of Competition Entities which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, Sponsors reserve the right in its sole discretion to cancel, terminate, modify or suspend the Competition. Should the Competition be terminated prior to the stated end date, notice will be posted on www.carrottop.com and the Competition will continue or be suspended or terminated in a manner that is as fair and equitable as possible as determined by Sponsors. Each Competitor and his/her parents and legal guardian(s) agree to indemnify and hold harmless Competition Entities from and against any and all liability resulting or arising from or in connection with the Competition, to release all rights to bring any claim, action or proceeding against Competition Entities, and hereby acknowledge that Competition Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prize.
10. Request for Names of Winners and Official Rules: For the names of the Winners and/or Official Rules, send a self-addressed stamped envelope to: Langdon Flynn Communications Attn: “Carrot Top National Prop Contest”, 2760 Lake Sahara Rd., suite 100, Las Vegas, NV, 89117. All requests for a copy of the Official Rules and for the name of the Winners must be received by January 15, 2010. Please note on the bottom left-hand corner of the front of your outer envelope whether you are requesting “Official Rules” and/or the name of the “Winners”. Vermont residents may omit return postage if requesting a set of Official Rules.
